Externado de Colombia.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0c8d26e elementor-widget elementor-widget-text-editor\" data-id=\"0c8d26e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Se ha publicado, en diferentes medios de comunicaci\u00f3n, que la Procuradur\u00eda General, inici\u00f3 una investigaci\u00f3n contra varios docentes en la ciudad de Cartagena por, presuntamente, ocupar varios cargos p\u00fablicos. Seg\u00fan un comunicado oficial emitido este jueves 21 del mes de noviembre del 2024, estos profesores habr\u00edan laborado tanto en la Universidad de Cartagena, como en instituciones educativas del sector p\u00fablico, lo que viola las normativas establecidas en la Constituci\u00f3n y en la Ley 4a. de 1993.<\/span><\/p><p><span style=\"font-weight: 400;\">Si bien es cierto, el art\u00edculo 128 de la Constituci\u00f3n trae una prohibici\u00f3n expresa a los administrados en no poder desempe\u00f1ar de manera simult\u00e1nea dos empleos p\u00fablicos, ni recibir m\u00e1s de una asignaci\u00f3n, encontramos que el constituyente en este mismo art\u00edculo vislumbro la posibilidad de que esta prohibici\u00f3n fuese regulada por el congreso de la rep\u00fablica mediante leyes, cuando dice: \u201c<\/span><b><i>salvo los casos expresamente determinados por la ley<\/i><\/b><i><span style=\"font-weight: 400;\">.\u201d.\u00a0 <\/span><\/i><span style=\"font-weight: 400;\">De lo que hay que decir que estas regulaciones fueron realizadas mediante la expedici\u00f3n de normas como la Ley 4a. de 1992 y la Ley 269 de 1996, junto con algunos decretos reglamentarios.<\/span><\/p><p><span style=\"font-weight: 400;\">El art\u00edculo 128 de la Constituci\u00f3n Pol\u00edtica y el art\u00edculo 19 de la Ley 4a. de 1992, parten de la prohibici\u00f3n <\/span><i><span style=\"font-weight: 400;\">\u201c<\/span><\/i><i><span style=\"font-weight: 400;\">Nadie podr\u00e1 desempe\u00f1ar simult\u00e1neamente m\u00e1s de un empleo p\u00fablico, ni recibir m\u00e1s de una asignaci\u00f3n que provenga del Tesoro P\u00fablico, o de empresas o de instituciones en las que tenga parte mayoritaria el Estado<\/span><\/i><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><span style=\"font-weight: 400;\">, pero esta \u00faltima, que desarrolla la norma superior, presenta una gama de excepciones, que permiten en algunos casos el desempe\u00f1o simult\u00e1neo de empleo p\u00fablico y\u00a0 la doble asignaci\u00f3n salarial as\u00ed; <\/span><\/p><p><b><i>a) Las que reciban los profesores universitarios que se desempe\u00f1en como asesores de la Rama Legislativa; <\/i><\/b><\/p><p><b><i>b) Las percibidas por el personal con asignaci\u00f3n de retiro o pensi\u00f3n militar o policial de la Fuerza P\u00fablica; <\/i><\/b><\/p><p><b><i>c) Las percibidas por concepto de sustituci\u00f3n pensional; <\/i><\/b><\/p><p><b><i>d) Los honorarios percibidos por concepto de hora-c\u00e1tedra; <\/i><\/b><\/p><p><b><i>e) Los honorarios percibidos por concepto de servicios profesionales de salud; <\/i><\/b><\/p><p><b><i>f) Los honorarios percibidos por los miembros de las Juntas Directivas, en raz\u00f3n de su asistencia a las mismas, siempre que no se trate de m\u00e1s de dos juntas; <\/i><\/b><\/p><p><b><i>g) Las que a la fecha de entrar en vigencia la presente Ley beneficien a los servidores oficiales docentes pensionados; Par\u00e1grafo. No se podr\u00e1n recibir honorarios que sumados correspondan a m\u00e1s de ocho (8) horas diarias de trabajo a varias entidades.<\/i><\/b><\/p><p><span style=\"font-weight: 400;\">De lo anterior cabe resaltar que el literal <\/span><i><span style=\"font-weight: 400;\">(d) Los honorarios percibidos por concepto de hora-c\u00e1tedra<\/span><\/i><span style=\"font-weight: 400;\">, obliga a realizar una remisi\u00f3n a la Ley 30 de 1992, donde se deber\u00e1 realizar un an\u00e1lisis minucioso de las vinculaciones que tengan los investigados, en esta norma se establecen algunas diferenciaciones de la vinculaci\u00f3n docente, tales como; <\/span><b>Docentes de Dedicaci\u00f3n Exclusiva<\/b><span style=\"font-weight: 400;\"> de tiempo completo o medio tiempo, los cuales son empleados p\u00fablicos, <\/span><b>Docentes de C\u00e1tedra, <\/b><span style=\"font-weight: 400;\">vinculados por contratos de prestaci\u00f3n de servicios, por lo que no son empleados p\u00fablicos ni trabajadores oficiales, <\/span><b>Docentes Ocasionales <\/b><span style=\"font-weight: 400;\">de tiempo completo o de medio tiempo, sus servicios son reconocidos mediante resoluci\u00f3n, pero no son empleados p\u00fablicos ni trabajadores oficiales y tampoco gozan del r\u00e9gimen prestacional regular, como tambi\u00e9n lo regulado en los acuerdos que tratan la materia al interior de las Universidades.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Ahora bien, frente al desempe\u00f1o de los docentes vinculados por hora c\u00e1tedra, enfatiza la Ley 30 de 1992 que, estos deben ser vinculados por medio de contrato de trabajo o mediante contratos de prestaci\u00f3n de servicios, con carga docente inferior a la de un docente de medio tiempo de la misma universidad y con una remuneraci\u00f3n que no podr\u00e1 ser inferior a 8 salarios m\u00ednimos legales vigentes (SMLV), por disposici\u00f3n de la sentencia de Constitucionalidad C \u2013 517 de 1999, la cual interpret\u00f3 el art\u00edculo 106 de esta norma,\u00a0 definiendo situaciones como modalidad de vinculaci\u00f3n, carga laboral y remuneraci\u00f3n, aspecto que tambi\u00e9n deber\u00e1 ser objeto de an\u00e1lisis en la investigaci\u00f3n disciplinaria, revisando cada caso en particular.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Diferente an\u00e1lisis tendr\u00eda que d\u00e1rsele a los casos de los Docentes de las facultades de las Ciencias de la Salud, que son profesionales de la salud, ejercen la docencia en instituciones de educaci\u00f3n superior p\u00fablicas, pero tambi\u00e9n prestan sus servicios, como profesionales de la salud, en instituciones prestadoras de los servicios de la salud p\u00fablicas, a primera vista y de manera autom\u00e1tica pareciera, que en estos casos, por disposici\u00f3n del art\u00edculo 128 de la Constituci\u00f3n Pol\u00edtica y la Ley 4a. de 1992, se determinara tal prohibici\u00f3n, pero como bien se cit\u00f3 anteriormente el art\u00edculo 19 de esta norma, establece como r\u00e9gimen exceptivo, en su literal <\/span><i><span style=\"font-weight: 400;\">(e)<\/span><\/i> <i><span style=\"font-weight: 400;\">Los honorarios percibidos por concepto de servicios profesionales de salud. <\/span><\/i><span style=\"font-weight: 400;\">\u00a0Frente a la palabra <\/span><b>HONORARIOS, <\/b><span style=\"font-weight: 400;\">que trae el literal que es objeto de cita, encontramos que desde la Constituci\u00f3n de 1886 y con el acto legislativo 01 de 1936, se desarrolla expresamente el porqu\u00e9 del cambio de la expresi\u00f3n de \u201csueldo\u201d del constituyente de 1886 por la de \u201casignaci\u00f3n\u201d en 1936, dando claridad de que no pod\u00edan excluir las retribuciones de los congresistas, por lo que la definici\u00f3n adecuada de esta expresi\u00f3n, va dirigida a toda cantidad de dinero que se fija y destina al pago de prestaciones relacionadas con el servicio p\u00fablico oficial, present\u00e1ndose una excepcional\u00edsima regla.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">El art\u00edculo 128 de la Constituci\u00f3n Pol\u00edtica, tambi\u00e9n fue desarrollado parcialmente por la Ley 269 de 1996, en relaci\u00f3n con quienes prestan servicios de salud en las entidades de derecho p\u00fablico, atendiendo el esp\u00edritu de que los profesionales de la salud puedan garantizar la prestaci\u00f3n del servicio p\u00fablico de salud, sin perjuicio a que desarrollen otras actividades producto de otro empleo p\u00fablico, esta norma manifiesta de manera expresa que quienes presten de manera directa servicios de salud, enti\u00e9ndase la prestaci\u00f3n directa de los Servicios de Salud dirigidos a conservar o restablecer la salud de los pacientes, en este caso, podr\u00e1n desempe\u00f1ar m\u00e1s de un empleo en entidades de derecho p\u00fablico, pero esta excepci\u00f3n tiene unas subreglas as\u00ed; 1. Qu\u00e9 prestaci\u00f3n directa del servicio de salud podr\u00e1 ser m\u00e1ximo de doce horas diarias sin que en la semana exceda de 66 horas; 2. Puede existir concurrencia de horarios si se ejercen actividades de car\u00e1cter docente asistencial que se realicen en las mismas instituciones en las cuales se encuentre vinculado el profesional de la salud, y que por naturaleza de sus funciones, ejerza la docencia y la prestaci\u00f3n directa de servicios de salud; Se pueden adecuar las relaciones laborales de los trabajadores oficiales y empleados p\u00fablicos del sector, modificando las jornadas a las establecidas en la presente Ley, mediante el traslado horizontal a un cargo de igual grado, nivel y remuneraci\u00f3n acorde con la jornada establecida, pudiendo disminuir o aumentar la intensidad horaria seg\u00fan el caso, siempre que las circunstancias del servicio lo permitan. Esta tem\u00e1tica fue tratada bajo demanda de Nulidad Electoral, donde fuimos defensores de un decano de la Facultad de Medicina de la Universidad de Cartagena, resuelta en segunda instancia por el Consejo de Estado, Secci\u00f3n Quinta, donde obtuvimos sentencia favorable (ver Sentencia aqu\u00ed <\/span><a href=\"https:\/\/www.consejodeestado.gov.co\/documentos\/boletines\/225\/13001-23-33-000-2018-00496-02.pdf\"><span style=\"font-weight: 400;\">https:\/\/www.consejodeestado.gov.co\/documentos\/boletines\/225\/13001-23-33-000-2018-00496-02.pdf<\/span><\/a><span style=\"font-weight: 400;\">).\u00a0 En esta Sentencia se desarrollan aspectos interesantes sobre la concurrencia de horario y la doble asignaci\u00f3n de los servidores p\u00fablicos, bajo el an\u00e1lisis propio del Proceso de Nulidad Electoral, pero que servir\u00e1n incluso para realizar un an\u00e1lisis de la responsabilidad disciplinaria de este tipo de conductas que se desprenden del art\u00edculo 39, numeral 13 de la Ley 1952 de 2019. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-3120541a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3120541a\" data-element_type=\"section\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t\t<div class=\"elementor-background-overlay\"><\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-77a2dfdd\" data-id=\"77a2dfdd\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-3da36a26 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3da36a26\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-no\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-14 elementor-inner-column elementor-element elementor-element-36d9a3cc\"
